Family-funded and proxy property purchases: ownership, control and ABSD risk

Putting a property in another person’s name can create consequences that last far beyond the purchase.

Start with the real arrangement

A parent helping a child with a genuine gift is not necessarily the same as a purchase where the funder expects to retain control, receive sale proceeds or remain the true beneficial owner. The documents, money flow and actual intentions matter.

Legal title brings real control

The registered owner may have legal rights over the property and may also carry the mortgage, tax and regulatory responsibilities. Informal understandings can become difficult if relationships change, a party dies, divorces, becomes insolvent or needs to sell.

ABSD and tax cannot be planned by labels alone

Authorities may look beyond the name on the title to the substance of an arrangement. Trust structures and transfers of beneficial interests can attract specific stamp-duty treatment. A private agreement does not automatically make a structure compliant or tax-efficient.

Before committing

Clarify whether the funding is a gift, loan, trust or another arrangement; who controls the property; who receives rent and sale proceeds; and what happens on death or disagreement. Independent Singapore legal and tax advice should be obtained before money is transferred or an option is exercised.

Questions worth considering

The headline may be significant, but how much does it materially change the decision for a buyer or owner examining ABSD and ownership? The useful answer may depend on timing, entry price, holding costs and the alternatives available at the same point.

It is also worth separating a broad ownership & policy signal from an advantage specific to one property. Which evidence would still need to be checked—and what could affect demand, flexibility or the eventual exit audience?
